Ao contr\u00e1rio, \u00e9 por saber da adequa\u00e7\u00e3o do procedimento \u00e0s necessidades, \u00e0s potencialidades e aos recursos dispon\u00edveis em cada caso que opta-se pela justi\u00e7a restaurativa. A justi\u00e7a, sob esse \u00e2ngulo, nunca pode ser defendida sob um modelo \u00fanico, ou ainda por um modelo &#8220;melhor&#8221; ou &#8220;mais democr\u00e1tico&#8221;; ao contr\u00e1rio, a justi\u00e7a s\u00f3 pode ser vivida.
